Terms of Service

This Terms of Service Agreement ("Agreement") is entered into by and between you ("User", "Client", or "You") and Visual Media Monitor, a company registered under the laws of India, with its principal place of business at New Delhi ("Company", "We", "Us", or "Our"), governing your access to and use of the Platform, including but not limited to any associated websites, software applications, video hosting services, media files, APIs, and other associated tools, products, or services (collectively, the "Service").
1. Acceptance of Terms
By accessing, registering for, or using any part of the Service, you expressly acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, and any additional guidelines, rules, or disclaimers posted on the Platform. If you do not agree with any of these terms, you must refrain from accessing or using the Service.
2. Definitions
- Content: Any video clip, image, text, metadata, broadcast segment, or information made available through the Service.
- Broadcaster: The original owner, licensor, or distributor of a television program, news broadcast, or audiovisual work.
- Authorized User: A client, agency, or their employee with legitimate, limited access to the Service under contract or license.
3. Service Description
The Service enables Authorized Users to view and access curated excerpts of publicly aired television news content for the limited purpose of media monitoring, internal analysis, industry benchmarking, public relations tracking, or similar research-driven use.
4. Access and User Obligations
- Access to the Service is restricted to Authorized Users only.

Users agree not to:
- Circumvent, disable, or interfere with access restrictions.
- Share, sublicense, or resell access to the Service.
- Use automation (bots, spiders, scrapers) to extract data.
- Misrepresent the purpose of their use.
- Users must ensure that access credentials remain confidential and secure.
5. Content Ownership and Intellectual Property
- All third-party Content remains the sole property of its respective owners or licensors.
- The Company does not claim ownership of any media clips hosted on the platform.
- Use of Content does not imply endorsement, sponsorship, or affiliation with the original Broadcaster.
6. Use Rights and Limitations
- You are granted a limited, non-exclusive, non-transferable, and revocable right to access and use the Service for non-commercial, internal research, and analysis purposes only.

You shall not:
- Reproduce, republish, broadcast, or publicly perform any Content without written authorization.
- Embed or download Content.
- Modify or create derivative works based on any Content.
- All clips include mandatory attribution such as broadcaster name, air date, and copyright reference.
7. Third-Party Content and Sources
- The Service may link to third-party content including broadcaster logos, metadata, or platforms like YouTube or news sites.
- The Company does not endorse or assume responsibility for such third-party content.
8. Fair Dealing and Copyright Exemptions
- The Service operates within the scope of Section 52 of the Indian Copyright Act, allowing "fair dealing" for reporting, review, or research.
- Content is curated in good faith to include only short, factual, newsworthy segments. If you are a rights holder and object to use, contact legal@yourdomain.com.
9. Disclaimer of Warranties
- The Service is provided "as is" without warranties of any kind.

- Accuracy, currency, or uninterrupted availability of Content.
- Availability of third-party sources.
- Performance without errors.
10. Limitation of Liability
To the fullest extent permitted by law, the Company is not liable for any damages arising from:
- Inaccurate or misleading content
- Unauthorized access or misuse
- Data loss
- Legal claims from third parties
11. Indemnity
You agree to indemnify and hold harmless the Company, its directors, employees, affiliates, and partners from claims arising due to:
- Your use of the Service
- Violation of this Agreement
- Infringement of third-party rights
12. Termination
- The Company may suspend or terminate your access without notice for any breach or misuse.
- Content may be removed or restricted at the request of authorities or copyright owners.
13. Modifications to Terms
We may update these Terms periodically. Continued use of the Service after updates constitutes acceptance. Please check our website regularly for the latest version.
14. Governing Law and Jurisdiction
This Agreement is governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Delhi.
